Please read our rental agreement carefully before booking. By renting a vehicle from MotoStyle, you agree to these terms.

1. Terms of Vehicle Operation

1.1 Authorized Road Surfaces

All vehicles must be operated exclusively on standard asphalt (paved) roads. Drivers are required to adhere strictly to the Greek Traffic Code (K.O.K.) at all times.

1.2 Off-Road Prohibition

Operating any vehicle type on non-paved surfaces is strictly forbidden. This prohibition includes, but is not limited to:

  • Unsealed dirt roads and rural tracks
  • Beaches, sandy areas, and fields
  • Mountainous trails and rocky or unmaintained paths
1.3 Breach of Agreement & Penalties

Driving on any non-asphalt surface is considered a fundamental breach of the rental contract. In the event of such a violation:

  • Insurance Forfeiture: All insurance policies and waivers are immediately rendered void.
  • Full Liability: The Customer assumes total financial responsibility for all resulting damages (direct or indirect), including vehicle recovery costs and compensation for the company’s loss of rental revenue.
1.4 Improper Handling & Negligence

Insurance does not cover damages caused by reckless behaviour, intentional misuse, or gross negligence. Any damage that falls outside the scope of “standard wear and tear” — specifically when resulting from a violation of these terms — will be charged entirely to the Customer.

2. Driver & Occupant Regulations

2.1 Passenger Limits & Safety
  • Scooters, Quads & Buggies: These vehicles are strictly licensed for a maximum of two (2) persons.
  • Cars: The number of passengers must never exceed the official seating capacity specified by the vehicle’s manufacturer.

Important: Carrying more passengers than permitted will result in the immediate cancellation of all insurance coverage, placing full financial responsibility on the Renter.

2.2 Registered Drivers Only

Operating the vehicle is strictly permitted only for the individuals officially named in the rental contract. If an unauthorised third party is found driving the vehicle, all insurance protections are automatically voided, and the primary Customer will be held fully liable for any consequences or damages.

3. Geographical Limits & Insurance Validity

Insurance protection remains in effect only within the specific regions and distance limits outlined below. These boundaries are calculated starting from our rental base in Stalis and apply regardless of the insurance plan you have purchased.

Plan your ride safely! Smaller quads, scooters, and buggies are perfect for nearby adventures around Stalis and Hersonissos, while larger vehicles are ideal for exploring a wider area. Our team will explain the specific boundaries for your vehicle in detail at pickup, including marking them on a map for your reference.

Please note: Exceeding the designated geographical boundary for your vehicle category constitutes a breach of the rental agreement and will result in the immediate voidance of all insurance coverage. The specific zones applicable to your rental will be explained and marked on a map at pickup.

4. Mileage Conditions

We provide unlimited mileage at no extra cost for all our rentals, provided that the vehicle remains within the designated boundaries and follows the usage guidelines mentioned above.

Note: The “unlimited mileage” policy does not grant permission to exceed the specific regional or road-type restrictions associated with your vehicle category. Unlimited mileage applies within your designated zone only.

5. Traffic Infringements & Administrative Charges

The Renter assumes full responsibility for all traffic violations, parking citations, road tolls, and administrative penalties issued during the rental term. This liability remains with the Renter even if the notification of a fine arrives after the vehicle has been returned.

5.1 Reporting & Settlement

It is mandatory for the Customer to disclose any fines or traffic tickets received during the rental period to the Company. In the event of a violation, the Company maintains the right to process the following charges:

  • Fine Recovery: The total cost of the specific ticket or penalty.
  • Administrative Fee: A processing and handling surcharge for each violation, as authorised by current legislation.

6. Booking Terms, Duration & Returns

6.1 Agreement Duration

The specific rental timeframe is strictly governed by the dates and times specified in your booking confirmation or the signed rental contract.

6.2 Rental Day Calculation
  • Initial Day: The first day of the rental is defined as the period starting at 09:00 and concluding at 20:00 on the same calendar day.
  • Extended Duration: Every subsequent day thereafter is billed based on a full 24-hour cycle.
6.3 Delayed Returns

Returning the vehicle behind schedule without previously obtaining our consent may lead to penalty fees. This includes, but is not limited to, the automatic billing of an additional full day’s rental rate.

7. Fuel Management & Refueling Terms

7.1 Fuel Requirements

The cost of fuel is exclusively the responsibility of the Renter. Our policy operates on a “Same-to-Same” basis: vehicles are provided with a specific amount of fuel and must be returned at that identical level.

7.2 Fuel Discrepancies & Fees
  • Under-fueling: If the vehicle is returned with a lower fuel level than when it was collected, the Customer will be billed for the missing fuel. Additionally, a refueling service surcharge may be applied to cover administrative costs.
  • Over-fueling: No refunds or credits are issued for any surplus fuel remaining in the tank upon return.

8. Emergency Protocols: Accidents, Damages & Breakdowns

8.1 Mandatory Procedures

In the event of a mechanical failure, accident, theft, or any vehicle damage, the Renter is required to:

  • Instant Notification: Contact the Company immediately to report the incident.
  • Scene Retention: Remain at the location of the incident. Leaving the scene is strictly prohibited unless there is an immediate threat to personal safety or explicit instructions are given by the Company.
8.2 Forfeiture of Coverage

All insurance protections are automatically nullified if:

  • The Renter leaves the scene of an accident or incident.
  • The incident is not reported to the Company immediately.

Warning: Failure to follow these mandatory protocols will result in the Renter assuming full financial liability for all damages and costs.

8.3 Right of Repossession

The Company maintains the right to terminate the rental and repossess the vehicle without any prior notice or refund if it is determined that any terms of this agreement have been breached.

9. Insurance Provisions & Renter's Liability

9.1 Scope of Coverage

Insurance protection is provided based on the specific plan selected by the Customer. Validity of coverage is strictly contingent upon full compliance with all terms, conditions, and restrictions of this agreement.

Coverage is applicable only when:

  • The vehicle is operated within the authorised geographical zones.
  • Use is limited to the permitted road network (asphalt).
  • The incident occurs within the official rental timeframe.
  • The vehicle is operated solely by registered, authorised drivers.
9.2 Financial Liability & Loss of Use

In the event of an accident or damage where insurance remains valid, the Customer’s liability is limited to the maximum deductible (excess) amount specified in the contract. However, the Customer may also be held responsible for “Loss of Use” — compensating the Company for the revenue lost while the vehicle is being repaired or replaced.

9.3 Absolute Exclusion of Insurance (Voidance)

Insurance protection is automatically forfeited, and the Customer assumes total financial responsibility, in instances of gross negligence, illegal conduct, or breach of contract. This includes, but is not limited to:

  • Unauthorised Terrain: Off-road driving or use on non-asphalt surfaces.
  • Geographical Breaches: Exceeding distance limits, highway violations, or unauthorised transport outside of Crete.
  • Impairment: Driving under the influence of alcohol, narcotics, or any controlled substances.
  • Traffic Violations: Running red lights, ignoring STOP signs, speeding, or illegal manoeuvres.
  • Misconduct: Reckless or aggressive driving, racing, stunts, or intentional damage.
  • Procedural Failures: Leaving the scene of an accident or failing to report an incident immediately.
  • Capacity & Authorisation: Exceeding passenger limits or allowing an unregistered driver to operate the vehicle.
9.4 Supplemental Insurance & Personal Safety

Any optional or upgraded insurance packages are only valid if they have been selected and paid for in full prior to the rental. Please note that Personal Accident Insurance (PAI) for the driver is not included in standard packages and remains the sole responsibility of the Customer.
